Terms & Conditions

These Terms and Conditions govern the use of yieldzeniqhtvx.com, operated by Yieldzeniqhtvx SpA, a sociedad por acciones incorporated in 2021 before the Santiago Real Estate Conservator (Folio 41,226 No. 22,187), Tax ID 77.834.219-K, headquartered at Avenida Apoquindo 4500, 12th floor, Las Condes.

1. Nature of the service

Yieldzeniqhtvx is a real estate crowdfunding (crowdlending) platform registered with the Comisión para el Mercado Financiero under code PFC-2024-0094, pursuant to Fintec Law 21,521. We connect Chilean individuals and companies with residential construction projects that need capital. We are not a bank nor a pension fund manager.

2. Capacity to invest

To invest you must be at least 18 years old, hold a Chilean ID card or a valid foreign RUT, and complete the suitability questionnaire. Yieldzeniqhtvx may reject an application without stating cause when there are signs of suspicious activity under Anti-Money Laundering Law 19,913.

3. Risks

Investments made through the platform may result in total or partial loss of the capital contributed. Expected returns are merely referential and do not constitute a promise of profitability. Each investor declares having read and accepted the Risk Sheet associated with each building.

4. Fees

Yieldzeniqhtvx charges a 1.2% structuring fee on the amount contributed and an 8% success fee on the interest actually paid to the investor. Fees are automatically deducted at payment time and itemised in each monthly statement.

5. Intellectual property

The Yieldzeniqhtvx brand, its logo, texts, on-site photographs, renders and the platform itself are protected by Chilean Intellectual Property Law 17,336 and by the trademark registered with INAPI under No. 1,412,788. Reproduction without written authorisation is prohibited.

6. Changes

We may update these Terms to reflect regulatory changes, especially those issued by the CMF, the Central Bank of Chile or the SII. We will notify changes by email at least 30 calendar days in advance.

7. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Chile. Any dispute will be brought before the Ordinary Courts of Justice of Santiago, without prejudice to the consumer's right to file a complaint with the National Consumer Service (SERNAC).
